Ask the HR Expert — Active Duty Pay

Ask the HR Expert — Active Duty Pay

Q: Do we have to continue to pay active service members while they are completing their duty time?

A: No you do not have to pay them, but you must allow them the time off required to complete annual training/ deployments etc. Furthermore, your service man/ woman should be giving you as much advanced notice as possible.

There are quite a few employers who will pay their employees (usually the difference of what they make at their current job vs. the service member’s military pay) but, this is completely up to the discretion of the employer.

Bottom Line:
It is best practice and recommended to allow the service member the option to use his/her PTO that has accrued.
